Terms and Conditions

By submitting a Commissions Form, you are agreeing to the terms outlined below.

 I. General Terms

All communication is to be done via direct message of the client’s choosing (Instagram DM or Email). Clear visual references are required preferred for all commissions. For calligraphy commissions: all words, copy, and phrasing are to be provided by the client. For character commissions: pictures, reference sheets, or refrence pictures are required. You may include textual descriptions for poses and expressions, but it is preferred if you gave other visual references of these as well. If no clear visual reference is provided, the piece will be treated as an original design commission and priced as such.

II. Payment

All payments will be made in USD, via Zelle, Venmo, or Cash. Payments must be made in full, up front, before I can begin work on your commission. Failure to complete the payment in a maxium of two days will forfeit your commission slot. In the case that a payment is held, the client can either wait until they are released (may take from one to four weeks) before piece production starts, or request a refund - losing your commission slot.

III. Progress Updates

Commissions will be placed into an ordered queue, with the first commissions to be accepted, becoming the first to be worked on, as well. Due to the time availability changing every month, timeframes may vary. Depending on the complexity of the commissioned piece, the queue, and artist’s schedule, it may be as little as a few weeks or as long as a few months or more. If your commission has a specific deadline (for a birthday gift, or some other special occasion), then this must be discussed prior to paying for the commission, as an additional fee is added if it needs to be moved up on the queue to be completed on time.
The client will receive updates on the state of the piece when stages such as sketch, base colors and rendering are complete. **You may ask for updates whenever you want, but please be patient as I'm not logged on social media all day, every day.

**This does not apply for calligraphy pieces. Due to the nature of writing, once the copy, spacing, and design has been agreed upon, there won't be any updates until the piece is done unless I run into an issue.

IV. Customer Satisfaction

I will do my best to correct mistakes made and be as transparent as possible with my clients about the process and state of their commission. The progress updates will allow for some revisions to be made, if requested:
For ART: During the sketch phase, you may request up to 2 free revisions, with the third and beyond incurring a revision fee. A complete do-over of the sketch I provide will incur a more substantial fee, which may vary depending on the complexity of the piece.
During the coloring and rendering phase, any revision that requires me to completely redraw parts of the work will incur a revision fee. Color changes and minor adjustments will be free.

For CALLIGRAPHY: During the planning phase (if original designing must be done by me in pencil before continuing to ink), you may request up to 3 free revisions, with the fourth and beyond incurring a revision fee. A complete do-over will incur a more substantial fee, with the client covering any extra material costs.

V. Usage & Copyright

I, Ashley (Ash), hold all rights to the commissioned work itself; meaning that I, as the copyright holder, am allowed to:

  • Use the work in public spaces for the purpose of self-promotion.

  • Post the work on public galleries and social media sites.

  • Claim ownership of the work itself.

  • Include the work in art books or packs that may be sold for profit.

  • Use the work for making merch such as prints, stickers, etc. This does not apply for commissons depicting original characters or real people.

You, the client, are allowed to:

  • Print and display the work for personal use only, unless contractually agreed otherwise.

  • Claim rights to the character depicted in the work, but not the work itself.

  • Use the work for self-promotion, to post on public spaces as they desire, but only with proper credit given to the original artist - Ashley (Ash) Womack or @ashmademe.

Breaking these terms of service will result in your personal use license of the work to be revoked, and possible blacklisting from further service. Examples of copyright infringement are as follows:

  • Reproducing and using the copyrighted work for commercial purposes without a commercial license. (Simply put, selling the piece for profit or merch in any way, without permission.) This is including but not limited to: minting as an NFT (Non-Fungible Token) or other such digital commodities on cryptocurrency blockchains, and reproducing art as stickers, prints, clothing etc.

  • Wrongfully taking credit for the creation of the work itself.

  • Removing any watermarks/signatures from the work.

  • Creating unauthorized edits of the work.

VI. Canceling & Refunds

Please note that I, the artist, retain the right to cancel and refund the commission at any point in time for one reason or another. I will always refund your commission in full if I cannot complete it. You, the client, do NOT have the ability to cancel or request a full refund once you have agreed to these conditions and paid for the piece. If the commission has not yet been completed after more than three month’s time, you may request a refund on that basis, but ONLY if the image has not yet been completed. If a commission’s sketch phase has been approved and set up for painting, then you will only receive a 50% refund. If the coloring phase has been approved, you will receive a 30% refund. Refunds will not be given for any reason once a piece is considered “finished”, meaning, the rendering has been completed. Any refunds will be processed when it is financially viable for me to do so - even if I approve a request for a refund. Please be patient if it takes some time. Attempted chargebacks will mean you lose the right to your commissioned work, and said work will be repurposed for another commission or personal piece. The chargeback will be disputed, and you will be blacklisted from future commission work from me. I may also, at my discretion, opt to warn other artists and encourage them not to take further commission work from you.

VII. Other

For pricing information check the Commissions page. All prices are subject to change at any time and are not negotiable to go lower. These prices are only referential and the final price will depend on the complexity of the piece and how close the deadline is. These terms and conditions can be adjusted based on the nature of the commission and can be discussed via DM or Email. If you do not wish for the commission to be posted on social media, please let me know in advance.
